My next door neighbors are renters in a building that's mostly owner-occupied. In the past, I've had a lot of trouble with them playing music late at night-- I sleep right next to the wall that we share, and even at moderate volume the bass from their music carries into my unit and keeps me awake. There's one master tenant for the[ unit, and a revolving door of roommates and guests.

Early last year I had it out with the master tenant. He agreed that they would turn the music off by midnight to avoid keeping me awake. Technically the building's quiet hours are 10 p.m. to 8 a.m., but I'm never in bed by 10 so I don't care about that. They've mostly been pretty good since then, with only one or two incidents.

Tonight I had to go over at 4:30 in the morning to tell them to turn the music off. One of the roommates answered the door, and I got the impression that the master tenant wasn't there at the time. I then fired off email to the master tenant:
Austin,

I just had to ask your roommates to turn down the music. I know
it's new years eve, but even so, 4:30 a.m. is just is not cool.

Would you please remind your roommates that music needs to go off
by midnight? It may not seem very loud to you, but bass carries.
Alternately, maybe you guys could switch to different music after
that time? I could make a few suggestions:

I cc:ed the mail to the HOA's board of directors. I'm not quite sure why I did that, whether it was to vent frustration, document the complaint, or Have Something Done. A part of me really feels like an ass for escalating it, especially since the guys have been pretty good recently. On the other hand, 4:30 a.m. is way over the line, even on new years eve.

What do you think? Was I a dick?

I don't think you're a dick, but I'm very sensitive to noise and get really annoyed by people who don't recognize that they live in shared spaces and are loud at inappropriate hours.

I don't think so. I think saying "hey, it's 1:00am, shut the music down" might be dick-like *on new year's*. But 4:30am? Hell yes tell them to shut the fuck up.

Certainly not. If Austin agreed with you about the noise issue, he should have at the very least communicated that to any present or future roomates with which he has/had (should have) a 'lease' agreement. In shared quarters, even if the building is right next door, sound certainly carries, and it carries even further at night. Not everyone has the weekend off, and as someone who's had to speak to the next door neighbors (who don't live 'right next door') about noise issues, it can be unsettling to be having to listen to an engine rev countless times while trying to get some sleep (during the day for me at the time).

If they're so in need of listening to their music, they can use headphones and blow out their eardrums, and let the rest of the us get some much deserved rest.

I think you were a dick. But I think you had every right to be given the history. If this had been any other night besides NYE then I would say that notifying the HOA was entirely reasonable. As it is I certainly don't blame you one bit, though I think some effort to head this off at the pass before 4:30 on one of the biggest paryt nights of the year would have been the non-dick move.

It depends a lot on how activist/busybody the HOA generally is, and what actions you think they're likely to take. Basically, mild escalation seems reasonable, but anything major seems an overreaction.

If you expect this will cause fines and/or harassment from the board, it's a little bit dickish. If you expect it'll just get filed and forgotten, then it's a very reasonable documentation and mild escalation.

Even if it's an overreaction, it's a pretty minor one, and very understandable.

Possibly bringing in the board of directors was dick-like; depends, as others have said, on how that board tends to operate.

Playing music loud enough to keep you awake at 4:30 in the morning is also exceedingly dicklike.

Oh, asking them to turn it down is totally not dickish. I have no problem with that, especially since I've explicitly negotiated an agreement with the master tenant. For NYE I'd let it slide until about 2-2:30, easily. At 4:30, I just wanted to get some bloody sleep, and my only option was to ask them to turn the music off.

The only real dick move would have been going to the board with it. Still, leaving a paper trail doesn't seem horrible.

Having been on the receiving end of said action, no... you at least went to the responsible parties first. When it happened to me, she went straight to the landlord, which went poorly.

Not a Dick....

What are the rules for people living in the unit? I know where I live, if I had a guest for more than 2 weeks I could get fined (I'd need to get them the lease at that point in time).

The in and out.. the not knowing what the deal is... seems like part of the problem is the people there.

At 4:30 I would have just called the cops... but i'm a Dick

It's a condo, not an apartment complex. There are rules for living in the building, and rules for whether it can be rented out or not, but who can live there is pretty much up to the landlord.

Calling the OPD away from holiday homicides wasn't really the right answer. Plus, it wasn't a super-loud party-- from the far side of my loft, I could barely hear it. It was only obnoxious when I went to bed and got to hear the constant pounding of bass.

I'm in the group that thinks that copying the HOA is just a little outside the lines, only because it was New Year's Eve, and the music hadn't been bothering you very long, even if it had been going on forever.

If they didn't turn it down, then I would write to the HOA.
